BIPLA Patent Office Practice Committee Prepares Comments Regarding the USPTO Notice of Proposed Rulemaking on Terminal Disclaimers and Double Patenting

The Patent Office Practice Committee held a hybrid meeting, in person at Wolf Greenfield and via Zoom, on May 30, 2024.  Members attended and engaged in a lively and thoughtful discussion about the USPTO’s Notice of Proposed Rulemaking regarding the use of Terminal Disclaimers to obviate rejections made based on obviousness-type double patenting. Following the meeting, the Committee prepared and filed comments in response to the Notice, which can be found below and at this link. Many thanks to Jonathan Roses, Nicole Palmer, and Matthew Van Eman for their work in organizing the event and preparing the comments for submission.
