Amicus brief of Amicus Curiae BIPLA in Island Intellecutal Property LLC v. TD Ameritrade, Inc.

The BIPLA, represented by Kia Freeman, Matt van Eman, and Katarina Overberg of McCarter & English, submitted an amicus brief in support of the petition for writ of certiorari in Island Intellectual Property LLC v. TD Ameritrade, Inc. et al. The brief addressed the second question presented by Island IP, asking whether it is appropriate for the Federal Circuit to issue one word affirmance decisions under its Rule 36. BIPLA argues that the Federal Circuit’s practice of issuing one word decisions erodes public confidence that each of its decisions has a principled justification. The BIPLA thanks Attorneys Freeman, van Eman, and Overberg and the McCarter firm for their pro bono representation in preparing this brief and BIPLA Amicus Committee for its support.
