Stay on top of simultaneous Hatch-Waxman and PTAB proceedings as they quickly become the norm in biopharma patent litigation. BPLA’s Biotechnology Committee will explore the interface between these proceedings in a
double mock trial
on September 28, 2017. Join us for lunch and simulated PTAB and District Court hearings with an all-star cast of mock judges and lawyers. We will delve into issues litigants routinely face when balancing these proceedings, such as litigation stays, joinder of PTAB petitions, and much more.
In a Hatch-Waxman litigation, our mock district court judge and attorneys will consider a stay of the district court proceeding pending resolution of the IPR. And the PTAB judges and attorneys will evaluate whether to join a late petitioner to their proceeding.
